Erika Jayne is experiencing more legal peril as she now faces a default judgment amid her ongoing fight with the Marco Marco design studio.
Just days after it was reported that the 53-year-old Real Housewives of Beverly Hills star would be headed to trial to face off against her estranged husband Thomas Girardi‘s bankruptcy trustee, who sued her for $24 million amid Thomas’ fraud crimes against his former clients, attorney Ronald Richards has shared an update on another case against her.
“Erika Girardi IS FACING A DEFAULT in Marco Morante‘s Florida case. He is the other founder of Marco Marco. Christopher Psaila is suing her in California. This arises out of the failed secret service case against Psaila,” Ronald wrote in a March 28 post on X, formerly known as Twitter.
As RHOBH fans may recall, Christopher accused Erika of extortion and plotting to ruin his career, claiming she falsely accused him of making around $800,000 in unauthorized charges to her American Express card, and suggesting Thomas used his legal connections to take action against him.
According to Ronald, attorney Jim Wilkes, who is representing Erika and those who work with her, allegedly made a clerical mistake pertaining to Marco’s case.
“He didn’t file his motion to dismiss correctly and failed to show up for the case management conference. The Court struck the motion and is allowing a default to be taken,” Ronald claimed. “[Erika Jayne] is in hot water now and is on the verge of losing this lawsuit.”
Ronald then noted that Erika’s other attorney, Evan Borges, wasn’t hired for the case, potentially to cut costs amid her legal drama, or because Jim was licensed to practice in Florida.
Back in January, while appearing on the WWHL: After Show, Erika offered an update on her relationship with Thomas amid their ongoing legal drama, sharing that his status was a “sad ending.”
“It’s just awful. He was found competent, found guilty. And then I guess he’s in a place where they assess what they do for sentencing. That’s how I understand it,” she explained. “It’s so out of my hands and beyond my control at this point, and it’s just sad all the way around. It’s a rough ending.”
